Biden NLRB Picks Will Advise on Joint Employer Suit, Chair Says

Two Democratic members recently confirmed to the National Labor Relations Board will weigh in on a lawsuit over a Trump-era rule on joint employment, after Republicans on the congressional labor committees expressed concern that their previous union work created potential conflicts.

The NLRB’s designated ethics official found that Gwynne Wilcox and David Prouty, who formerly worked for Service Employees International Union affiliates, don’t need to recuse themselves from a pending federal court challenge the union filed over the rule, NLRB Chair Lauren McFerran (D) said in a letter Friday.
