Avon, New Avon Workers Get Mixed Rulings in Pregnancy Bias Suit

Three women suing Avon Products Inc. and spinoff New Avon LLC for alleged classwide discrimination against pregnant workers and nursing mothers saw their claims trimmed by the Southern District of New York.

Caroline Ruiz escaped New Avon’s bid to force her claims into arbitration. A new employment agreement, which Ruiz signed after her start date was delayed, superseded her promise to arbitrate, Judge Vernon S. Broderick said Sept. 22. The new agreement was executed subsequent to Ruiz’s signing the company’s arbitration pact and provides that any employment disputes are to be decided in court.
