AutoZone Managers Lose Collective Status in Overtime Suit

More than 700 managers will now have to individually pursue claims that AutoZone Stores Inc. misclassified them as exempt from overtime pay, after a federal judge decertified their Fair Labor Standards Act collective.

The plaintiffs’ testimony revealed that they had different job duties and varying levels of authority over managerial responsibilities like hiring, firing, and promoting, depending on which AutoZone location they worked at.

As such, they failed to establish that they’re similarly situated to the extent necessary to maintain collective status, Judge Abdul K. Kallon said Wednesday in granting AutoZone’s motion for decertification.
