AT&T Can Keep Recording Ban Used to Threaten Worker, NLRB Rules

AT&T Mobility can continue to enforce its prohibition on recording conversations in the workplace even though the company used the rule to unlawfully threaten a worker, a divided National Labor Relations Board said.

The NLRB’s Republican members on Monday overruled part of the board’s 2004 decision in Lutheran Heritage that would have required the company to fix or rescind the rule after it was used to violate a worker’s National Labor Relations Act rights.
