AT&T Beats Would-Be Class Suit Alleging Stale Pension Data

AT&T Inc. defeated a lawsuit claiming it shortchanges certain workers’ pension benefits by using outdated life expectancy data, when a federal judge in the Northern District of California dismissed the case for lack of standing.

The original named plaintiffs had their lump sum pension benefits calculated using a legally compliant formula and therefore haven’t suffered an injury giving them standing to sue, Magistrate Judge Sallie Kim of the U.S. District Court for the Northern District of California ruled Monday. Kim dismissed the lawsuit without giving the plaintiffs an opportunity to refile.
