Anthem Sales Rep Loses Bid for Overtime Suit Collective Status

A former Anthem Cos. sales representative failed to convince a federal judge in New York to allow her to pursue unpaid overtime allegations as a collective action on behalf of other workers in the state.

Eugenia Caicedo, who accuses the insurer of misclassifying workers as outside salespeople ineligible for overtime pay, “provides almost no facts to support” her argument that she was similarly situated to Anthem’s other non-managerial employees, the US District Court for the Southern District of New York said.
