Abiomed Defeats Whistleblower’s False Claims Retaliation Suit

A former director for healthcare technology company Abiomed Inc. failed to show that his termination from the company violated the the False Claims Act’s anti-retaliation provision, a Massachusetts federal court said.

Max Bennett didn’t show that Abiomed fired him in 2012 for reasons other than dishonesty during his hiring process about why he left his previous job, Judge Indira Talwani of the U.S. District Court for the District of Massachusetts said Tuesday.

Inquiries Bennett made with Abiomed about company policies didn’t hint that he was concerned about illegal or fraudulent activity, the court said.
