AmerisourceBergen Ordered to Give Opioid Records to Investors

AmerisourceBergen Corp. must turn over records to investors probing whether wrongdoing by the drug distributor’s board is to blame for its multi-billion-dollar legal exposure stemming from the nationwide opioid crisis, a Delaware Chancery Court judge ruled.

“The flood of government investigations and lawsuits relating to AmerisourceBergen’s opioid distribution practices is sufficient to establish a credible basis to suspect wrongdoing,” Vice Chancellor J. Travis Laster wrote.

AmerisourceBergen, one of the “big three” U.S. pharmaceutical wholesalers, faces two congressional investigations, a Drug Enforcement Administration probe, and a multidistrict lawsuit filed by cities, pension funds, and nearly every state attorney general. Those suits...
