Sheriff Order to Remove Covid-19 Instagram Post Unconstitutional

A Wisconsin teenager’s Instagram posts about her hospitalization with Covid 19-like symptoms were protected speech, a federal court in the state ruled, saying a sheriff and a patrol sergeant violated her First Amendment rights by ordering her to remove them or risk arrest or jail.

“Even if short and often grammatically scurrilous, social media posts do not fall outside the ambit of the First Amendment,” the U.S. District Court for the Eastern District of Wisconsin said.
