Illinois Governor’s Successive Covid Proclamations Lawful

A restraining order barring the enforcement of Covid-19 restrictions against an Illinois restaurant was thrown out after an Illinois appeals court found the governor has the authority to issue successive disaster proclamations.

The Illinois Emergency Management Act states that the governor may exercise his emergency powers for a period “not to exceed 30 days.”

But nothing in the language of the law precludes the governor from issuing multiple disaster proclamations—each with its own 30-day grant of emergency powers—arising from one ongoing disaster, the court said.
