Enterprise Can Ask 11th Cir. About Defense in Covid Layoff Case

Enterprise Holdings Inc. can ask the Eleventh Circuit to determine the proper standard for proving the Worker Adjustment and Retraining Notification Act’s “natural disaster” defense in a lawsuit challenging the notice workers received before being laid off because of the Covid-19 pandemic, a Florida federal judge ruled.

Elva Benson filed the proposed class action May 27, accusing the car rental company and two Florida subsidiaries of providing workers with less notice of their prospective layoffs than required under the WARN Act.
