Wet Ones Buyer Didn’t Show ‘Kills 99% of Germs’ Claim Deceptive

Wet Ones maker Edgewell Personal Care Co. defeated a false ad suit, as a California federal court said a purchaser failed to show how consumers would be fooled by representations that the antibacterial wipes kill “99.99% of Germs,” are hypoallergenic, and gentle on skin.

Lauren Souter’s proposed class suit alleged the active ingredient, benzalkonium chloride, is ineffective against certain viruses, bacteria, and spores which make up more than 0.01% of germs and can cause serious diseases. Some of those diseases include polio, norovirus, human papillomavirus, crypotosporidium, and C. difficile, she said.
