Vi-Jon Hand Sanitizer ’99.99%' Germ-Killing Claims Not Deceptive

Hand sanitizer maker Vi-Jon Inc. shed, for now, a proposed class suit alleging its labeling deceptively says “kills 99.99% of germs,” as a California federal court said no consumer would think the product literally works against virtually all infectious organisms.

Anthony Moreno’s reading of the front label is implausible and inconsistent with how a reasonable consumer would understand the hand sanitizers’ function, Judge Jeffrey T. Miller of the U.S. District Court for the Southern District of California said Wednesday. Nonetheless, he may file an amended complaint, the court said.
