Union Member Can’t Recoup Unconstitutional Fair-Share Fees

A Pennsylvania public library employee lacked standing to bring a class action against her former union to recover the equivalent of unconstitutional fair-share fees nonmembers paid, the Third Circuit said Friday.

Bethany LaSpina paid full dues to be a member of her union. But her union was allowed by state law to collect a lower fair-share fee from nonmembers to compensate it for the benefits they received from its representation.
