Trans Teens Want Same Judge to Hear Surgery Coverage Disputes

Two Arizona teenagers want their proposed class action over the state Medicaid program’s categorical refusal to pay for gender-affirming surgery transferred to the judge overseeing a University of Arizona professor’s lawsuit over a similar exclusion in the state’s employee health plan.

The two lawsuits involve substantially the same legal issue—whether Arizona’s refusal to pay for medically necessary surgical treatment for gender dysphoria is discrimination on the basis of sex and transgender status in violation of Section 1557 of the Affordable Care Act, D.H. and John Doe told the U.S. District Court for the District of Arizona Tuesday.
