Tootsie Roll Must Face Trans Fats Lawsuit In State Court

Tootsie Roll Industries Inc. must face in California state court a proposed class action over the candy giant’s alleged use of artificial trans fats in its candies, a federal court in California ruled in granting the plaintiff’s motion to remand in a Zoom hearing Tuesday.

Maxine Beasley sued Tootsie Roll in Alameda Superior Court in January, alleging that its use of partially hydrogenated oils violated California’s Unfair Competition Law. The lawsuit claimed that Tootsie used dangerous products unnecessarily and that “most manufacturers of competing candy products responsibly decided to refrain” from using the artificial trans fats, instead opting for substitutes....
