Texas County Fails to Toss Paramedics’ Overtime Calculation Suit

A Texas county must face a wage-and-hour suit accusing it of shorting paramedics on overtime pay after a federal judge in the state rejected its bid to throw out the case.

Kendall County says that the paramedics fall under an exception to the Fair Labor Standards Act’s overtime rules, so the court doesn’t have jurisdiction to hear the case. But that argument “conflates coverage under the FLSA with subject matter jurisdiction,” the US District Court for the Western District of Texas said.
