Hershey Co. got a late Valentine’s Day present when a court threw out a proposed class suit alleging its Whopper’s and Reese’s Pieces candies were deceptively packaged.
Robert Bratton alleged the candies were packaged in underfilled cardboard boxes that tricked consumers into thinking they were getting more. This violated Missouri consumer protection law, he said.
The suit was one of dozens of “slack-fill” suits, alleging various kinds of products are misleadingly packaged in oversized containers with useless empty space.
