Starbucks Hot Drink Cheat Suit Thrown Out

Starbucks Corp. defeated a proposed class suit alleging it systematically underfills latte and mocha drinks by counting the milk foam toward the stated volume.

There was no deception, the U.S. District Court for the Northern District of California said, granting summary judgment to Starbucks Jan. 5.

The same principles led a different court to dismiss a proposed class suit alleging Starbucks tricked buyers of cold drinks by including ice in the stated volume.
