Rite Aid Sheds Most Claims in Diet Supplement Packaging Suit

Rite Aid Corp. got most claims cut from a suit alleging it deceptively packaged Rite Aid brand nutritional supplements.

Kaley Diann Silva and Lindsey Avenetti alleged the products’ principal display panel labels didn’t accurately specify the quantity of supplement ingredient per serving or the size of each serving.

The plaintiffs lack standing to pursue claims for injunctive relief such as label changes because they didn’t show they are likely to suffer future injury, the U.S. District Court for the Middle District of Pennsylvania ruled Sept. 19.
