Progressive Insurance Fraud Class Action Revived

A class action alleging a Progressive Insurance agent tricked policyholders into releasing their claims from car accidents was improperly dismissed, the U.S. Court of Appeals for the Third Circuit said Nov. 15.

The lower court erred in characterizing the case as a denial of insurance benefits not covered by New Jersey’s Consumer Fraud Act, Judge Marjorie O. Rendell wrote for the court.
