Panera Escapes Lawsuit Over ‘100% Clean’ Claims, For Now

A putative class action alleging that Panera LLC’s labeling and marketing of its food products as “clean” or “100% clean” is deceptive must be dismissed, but the plaintiff has 30 days to try again, a federal court in San Jose ruled.

Customer Brianna Tabler alleges that Panera’s products contain a residue of glyphosate, a synthetic herbicide developed by Monsanto and marketed as Roundup. This makes the company’s advertising and labeling—such as in-store signs saying “Food should be clean. No artificial colors, preservatives, sweeteners, flavors, or anything else you wouldn’t want to serve your family”—false and deceptive, Tabler claims.
