P.F. Chang’s Servers Get Collective Status in Tipped Wage Case

P.F. Chang’s China Bistro Inc. must face a conditionally certified collective of restaurant servers across 30 states on claims that it violated federal and state wage laws, a Pennsylvania federal court ruled Wednesday.

The evidence shows that P.F. Chang’s servers were subjected to the same corporate policies, regardless of restaurant location, requiring them to perform “side work” for a tip-credited wage, Judge Anita B. Brody of the U.S. District Court for the Eastern District of Pennsylvania said.

The court also rejected P.F. Chang’s attempt to limit the collective to residents of Pennsylvania and declined to rule on whether the U.S....
