Employees of Northwestern University who sued the school over its retirement plans on Wednesday asked the Seventh Circuit to rethink its recent decision rejecting their lawsuit.
The court’s March 25 decision in favor of Northwestern applied a “heightened pleading standard” that conflicts with the court’s prior decisions in Employee Retirement Income Security Act class actions, the employees said in their petition for rehearing in front of all the court’s judges. The decision also creates a circuit split with the Third Circuit, which in 2019 allowed a similar lawsuit to move forward against the University of Pennsylvania, the employees said.
