Nestlé Must Continue Defending ‘Poland Spring’ False Ad Suit (1)

Nestlé Waters North America Inc. must continue to defend most claims in a proposed consumer class suit alleging it fraudulently markets Poland Spring bottled water.

Plaintiffs sued under the laws of Connecticut, Maine, Massachusetts, New Hampshire, New Jersey, New York, Pennsylvania, Rhode Island, and Vermont.

They alleged Poland Spring products don’t meet the legal definition of “spring water” because the multiple sites in Maine where Nestlé obtains Poland Spring water aren’t natural springs.

The U.S. District Court for the District of Connecticut previously said all the claims were preempted by the Federal Food, Drug and Cosmetic Act.
