Illinois residents alleging they received prerecorded calls offering them a free cruise to the Bahamas can pursue their claims as a class, a federal court said March 21.
But the court lacks personal jurisdiction to certify a nationwide class, Judge Harry D. Leinenweber wrote for the U.S. District Court for the Northern District of Illinois.
The court cited Bristol-Myers Squibb Co. v. Superior Court, where the U.S. Supreme Court limited where companies may be sued by out-of-state plaintiffs.
