Family Advances Suit Over Blue Cross Minnesota’s Benefit Offsets

A proposed class action accusing Blue Cross and Blue Shield of Minnesota of wrongfully clawing back patients’ approved benefit payments is moving forward after a federal judge denied the insurer’s motion to dismiss.

Judge Michael J. Davis of the U.S. District Court for the District of Minnesota on Tuesday adopted a magistrate report rejecting the insurer’s argument that the lawsuit was procedurally improper.

The lawsuit was filed by a family that incurred more than $80,000 in medical bills for their daughter’s mental health treatments. After initially paying the claim, BCBSM reversed course and demanded the family reimburse the full amount....
