Costco’s California Greeter Seating Suit Returned to State Court

A district court lacked jurisdiction to deny Costco Wholesale Corp.‘s motion for partial summary judgment in a lawsuit alleging that it failed to provide greeters and exit checkers with suitable seating, the U.S. Court of Appeals for the Ninth Circuit ruled Thursday.

The lawsuit will be remanded to state court, where Judge J. Clifford Wallace said it should have stayed.
