Class Counsel in Experian Suit Wins Fee-Award Appeal (Correct)

Class counsel in a suit over Experian’s alleged failure to expunge certain information from consumer credit reports won an appeal of a $4 million fee award, as a split Ninth Circuit panel said Thursday the judge didn’t explain why such a low amount was in order.

The trial court failed to provide a sufficient explanation for its departure from the 25% benchmark that is typically used in the Ninth Circuit when fees are awarded as a percentage of the class fund, the 2-1 appeals court said in an unpublished ruling.
