AT&T Wins Federal Court Jurisdiction of Sales Staff’s Wage Suit

AT&T properly removed a wage-related suit by West Virginia sales staff from state to federal court a month after it was certified as a class action because no earlier filings triggered a 30-day removal deadline, a federal court ruled.

Joseph Atkins, Justin Roach, and James Hull allege in their suit against AT&T Mobility Services LLC that the company’s sales commission “chargeback” practices violate wage provisions of the West Virginia Wage Payment and Collection Act.
