Massachusetts Inmates, Lawyers Sue Over ‘Faulty’ Mail Drug Tests

A lawsuit against the Massachusetts Department of Correction in state court claims that its use of unreliable drug tests on legal correspondence unconstitutionally interferes with inmates’ ability to communicate with counsel.

The proposed class action, filed in Suffolk Superior Court on Wednesday, also names the test’s manufacturer, Sirchie Acquisition Co. LLC, and its distributor, Premier Biotech Inc, claiming that they knew or should have known about the high risk of false positives.
