Yelp Gets Circuit Panel Win in Lawsuit Alleging Unlawful Texts

Yelp Inc. beat a lawsuit alleging the company is liable for sending unsolicited texts to a Buffalo Wild Wings Inc. customer.

A three-judge Ninth Circuit panel on Thursday dismissed an appeal by plaintiff Marche Meeks on grounds of lack of jurisdiction.

Attorneys for Meeks and Yelp didn’t immediately respond to requests for comment.

Meeks sued Yelp and Buffalo Wild Wings in 2017, alleging violations of the Telephone Consumer Protection Act, which bans use of autodialers to text or call consumers without consent.
