A New York Yankees minor league affiliate convinced a federal judge to send its lawsuit against insurer CNA Financial Corp. over denied claims for pandemic-related business losses to a preferred, state court venue.
The Scranton Wilkes-Barre RailRiders argued that one defendant, a CNA unit, is also based in Pennsylvania, giving the state’s Court of Common Pleas the right to hear the case. Chicago-based CNA, though, claimed the unit lacked connection to the team’s insurance policy and was improperly joined, creating “complete diversity” of the parties as well as federal jurisdiction.
