UnitedHealth Beats Toxicology Labs’ Suit Over Testing Charges

UnitedHealthcare Insurance Co. defeated ERISA claims by two toxicology labs who said the insurer failed to pay about $50 million in urinalysis testing costs, when a Texas federal judge said the labs failed to properly seek payment through the appeals process of United’s health plans.

Mission Toxicology LLC and Sun Clinical Laboratory LLC presented no evidence that they exhausted United’s claims appeal process under the Employee Retirement Income Security Act on behalf of the thousands of patients whose testing charges were allegedly denied, Judge Jason Pulliam of the U.S. District Court for the Western District of Texas held Wednesday.
