Shopify Beats Class Action Alleging Unlawful Texts

Shopify Inc. beat claims in a California federal court that it violated an anti-robocall law by enabling text messages from a retailer that uses the company’s online platform.

No “significant facts” showed Shopify sent the messages, Judge Haywood Gilliam of the U.S. District Court for the Northern District of California, wrote Wednesday in granting the company’s motion to dismiss the case.

David Sheski filed an Oct. 21 class-action complaint accusing Shopify of violating the Telephone Consumer Protection Act, which prohibits companies from sending automated calls and texts to consumers without their consent.
