Servicemaster, Terminix Beat RICO Claims Over Fumigation

The ServiceMaster Co. and Terminix International Co. won dismissal of racketeering claims by the owners of a Virgin Islands vacation condo community stemming from a 2015 fumigation that sickened a family.

The story of the Esmond family, who were airlifted to a mainland hospital, was reported by several news outlets, subjecting the owners to bad publicity that caused them economic losses, the complaint alleged.

But the condo owners, Catalus Capital USVI LLC and VVS LLC, didn’t show that Terminix engaged in fraudulent activity, the U.S. District Court for the District of the Virgin Islands said March 18.
