Peloton May Depose 10 Unnamed Class Members in Consumer Suit

Peloton Interactive Inc. may conduct short, remote depositions of 10 unnamed potential class members in a suit alleging it deceived purchasers about its supposed “ever-growing” on-demand library of fitness classes, a New York federal court said.

The evidence is relevant to Peloton’s arguments that individual issues about liability and damages would overwhelm common ones, and that the three named plaintiffs aren’t typical of the proposed class, Judge Lewis J. Liman of the U.S. District Court for the Southern District of New York said.
