A Pennsylvania federal jury found that Nike infringed on Lontex Corp.'s “cool compression” branded clothing with its similar apparel.
Lontex, a Pennsylvania-area sportswear company, had accused Nike in the U.S. District Court for the Eastern District of Pennsylvania of selling confusingly similar clothing through retailers.
Nike had argued that its use of the term “cool compression” was protected by fair use.
The jury also found that Nike is contributorily responsible for infringement of the mark by other companies who sold Nike’s “cool compression” clothing, according to the verdict sheet.
