NHL ‘Culture of Violence’ Claims for State Court, Estate Says

The National Hockey League should be stopped from litigating in federal court state-law claims alleging it promotes a culture of violence and misrepresented the dangers of head trauma, the estate of deceased NHL player Steve Montador told the Northern District of Illinois.

The lawsuit should be remanded to state court because none of the claims are preempted by the Labor Management Relations Act, the estate told the U.S. District Court for the Northern District of Illinois Jan. 21.

With its motion, the estate filed a proposed amended complaint that, it says, “eschews any hint of a preempted claim.”
