Miami Fontainebleau’s Covid-19 Layoffs, Benefits Suit Falls Flat

Miami’s Fontainebleau Hotel on Wednesday lost its lawsuit accusing a health fund of improperly demanding about $5 million in contributions on behalf of workers laid off during the Covid-19 health crisis, when a Florida federal judge concluded he lacked jurisdiction to hear the hotel’s claims.

Fontainebleau’s lawsuit—which seeks a declaration that it doesn’t owe benefit fund contributions on behalf of more than 1,000 laid-off workers—isn’t authorized by the Employee Retirement Income Security Act or the Labor Management Relations Act, Judge Robert N. Scola Jr. of the U.S. District Court for the Southern District of Florida held.
