Limiting U.S. Judges to Mutual, Index Funds Weighed by Democrats

Congressional Democrats are looking into restricting federal judges’ investments to mutual and index funds, which could help them avoid recusal conflicts in most cases.

A congressional aide said Wednesday restrictions to funds are among other provisions being considered for a reintroduction of a House bill that would create additional ethical requirements for the judiciary called the 21st Century Courts Act.

Requiring more passive investments was floated at House Judiciary subcommittee hearing on Tuesday following a Wall Street Journal report that 131 judges failed to recuse themselves in cases where they had a financial conflict.
