IBM Must Face Another Tech Salesman’s Capped-Commissions Suit

An IBM Corp. tech salesman has enough evidence to advance his claims that the company unlawfully capped his commissions despite telling him that he had unlimited earning potential, a North Carolina federal court ruled.

William Stephenson presented evidence that IBM reduced his commissions based on arbitrary budget reasons and therefore didn’t follow the terms of his incentive plan agreement, Chief Judge Thomas D. Schroeder of the U.S. District Court for the Middle District of North Carolina said Monday, denying the company’s motion for summary judgment.
