Harbor Freight Tools USA Inc. and related companies won’t have to face a psychologist in a trial over injuries to three people from an allegedly exploding Blitz USA Inc. gas canister, a federal court in Georgia ruled April 22.
Failure-to-warn claims are no longer in play for the human factors expert to testify about, the U.S. District Court for the Middle District of Georgia said. And the expert isn’t qualified to testify on engineering issues, the court said.
