Federal Court Blocks Pennsylvania’s Anti-Bias Ethics Rule (1)

A federal judge temporarily blocked enforcement of Pennsylvania’s anti-bias ethics rule, dealing a blow to supporters of the controversial rule, including the American Bar Association.

Judge Chad F. Kenney of the Eastern District of Pennsylvania said the rule is unconstitutional viewpoint discrimination.

The “government cannot set its standard by legislating diplomatic speech because
although it embarks upon a friendly, favorable tide, this tide sweeps us all along with the admonished, minority viewpoint into the massive currents of suppression and repression,” Kenney wrote on the opinion Monday.
