ExxonMobil Gets $20 Million Clean Air Case Revived (1)

Exxon Mobil Corp. won’t have to pay a $20 million penalty for more than 16,000 Clean Air Act violations at the nation’s largest petrochemical complex, at least not until a Texas district court takes another look at the case, the Fifth Circuit ruled Wednesday.

The Sierra Club and the Environment Texas Citizen Lobby Inc. needed to prove they had standing for each alleged violation by demonstrating that their members’ injuries were traceable to Exxon’s complex, the U.S. Court of Appeals for the Fifth Circuit said in a non-dispositive ruling.
