ANALYSIS: Discovery Keeps Settlements Humming Despite Distancing

Social distancing has changed a lot about the practice of law, but it apparently has not changed settlement rates, according to a Bloomberg Law survey.

This pandemic-era stability suggests that discovery hasn’t lost its basic function in legal disputes: permitting lawyers to evaluate both sides of a case and find ways to help their clients come to terms. Because remote discovery also involves some relatively newfound efficiencies, don’t expect it to completely disappear when Covid precautions recede.
