It’s that time of year again. Bloomberg Law’s legal analysts are once again taking stock of the state of the legal industry as part of our annual outlook series. It is no accident that this year’s series is our biggest ever—there is much to cover as the year draws to a close.

The legal landscape has been impacted this year by a fascinating combination of political, economic, and judicial headwinds. Everything from rising inflation to persistent supply chain issues to a wild job market to major Supreme Court rulings have contributed to the current industry climate.

As a result, in this year’s series, our legal analysts offer their expert insights and perspectives across a wide array of trends and issues that practitioners should be following in 2023. The Bloomberg Law 2023 series is divided into five major topics—Litigation, Transactional, ESG & Employment, Technology, and the Future of the Legal Industry.

Our Litigation analysts examine how a wide swath of issues could play out in and out of court, including patent and privacy litigation trends, Section 230 and social media platforms, the major questions doctrine, and the impact of the litigation finance industry.

On the Transactional side, our legal analysts take a deep dive into the numbers, exploring broader trends in M&A and capital markets and forecasting what transactional attorneys can expect in those areas in 2023. In addition, we take a close look at state-level cryptocurrency enforcement and the continuing supply chain challenges.

Has there been a hotter, more politicized topic this year than ESG? Our legal analysts take a deeper dive into the issues surrounding ESG, with a particular focus on related employment topics. Our ESG & Employment coverage ranges from SEC rulemaking to pay transparency to employee well-being to the rise in unionization.

On the Technology front, our legal analysts explore a wide range of issues, including the state of femtech after the Supreme Court’s Dobbs decision on reproductive rights, trends in privacy laws and regulations, and what to expect in FTC enforcement in the coming year.

Finally, our legal analysts make their predictions on the Future of the Legal Industry. What progress will the legal industry make on DEI metrics in 2023? What developments will we see in the (de)regulation of non-lawyer ownership of legal service providers? Has “quiet quitting” impacted the legal industry? These are just a few of the questions our legal analysts explore as part of this year’s series.
