AmerisourceBergen Seeks Immediate Appeal in Opioid Records Case

AmerisourceBergen Corp. asked a Delaware Chancery Court judge to let it immediately appeal his ruling ordering the disclosure of company records to investors probing whether board misconduct is to blame for its multi-billion-dollar legal exposure stemming from the nationwide opioid crisis.

Vice Chancellor J. Travis Laster ignored binding precedent when he ruled earlier this month that shareholder “inspection rights do not depend on the existence of an actionable claim for damages against the board of directors,” the drug distribution giant argues in court papers filed Thursday.
