ANALYSIS: FTC’s Facebook Setback Could Lead to a Rare Loss

The U.S. District Court for the District of Columbia handed the Federal Trade Commission a setback on its bid to force Facebook Inc. to divest Instagram Inc. and WhatsApp Inc., competing companies the social media giant bought in 2012 and 2014. If the FTC ultimately loses the case, that would be an unusual event.

In the past 30 years of FTC antitrust cases filed in the D.C. court, which accounts for about half of the new antitrust cases the agency filed in that period, the agency got a favorable result 87% of the time.
