Peabody Energy Escapes California Global Warming Lawsuits

Coal producer Peabody Energy Corp. can’t be sued by two Northern California counties and one city for contributing to global warming, according to a Missouri federal court.

San Mateo County, south of San Francisco, and Marin County, to its north, and the City of Imperial Beach failed to assert claims by the deadline imposed in Peabody’s bankruptcy case, and their claims were discharged, or wiped out, by the bankruptcy, Judge Rodney W. Sippel of the U.S. District Court for the Eastern District of Missouri said in his March 29 decision.
